Ambassador Agreement

This agreement is between Xcape Tax Academy, 249 Oxley Ave, Margate QLD 4019, Australia (“we”, “us”) and you, as a Xcape Academy ambassador. It works alongside our Terms of Service and Privacy Policy.

1. Your role

• We review every application. Once approved, you refer students to Xcape Academy with your own links and codes from the ambassador portal.
• You’re an independent contractor, not an employee or agent. You can’t make promises or agreements on our behalf.
• You may promote other programmes too. Just don’t combine our links or codes with a competing training offer in the same post or message.

2. Links and codes

• You get personal share links, QR codes and brochures for each pathway, and you can create several codes.
• Each code can pass part of your commission rate to the student as a discount. A code with a discount works for one student only; a code without one can be used by anyone.
• A code is claimed when a student applies with it, and released if that application ends without ever being approved.

3. Who gets credit

• The code entered on the student’s application decides which ambassador is credited. Your links fill in your code and remember it for 90 days.
• You earn commission only on enrollments we approve. Self-referrals and referrals of people in your household don’t earn commission.

4. Commission

You earn a percentage of what each referred student actually pays for their pathway, after any discount. Your rate is your level’s rate minus any discount your code passed on, and it’s locked in when the student’s enrollment is approved.

Years count from your first approval as an ambassador. We may also place you on a level directly.

5. When commission is paid

• Commission becomes payable 30 days after the student’s payment or 7 days after they complete the pathway, whichever is later. This covers the refund window.
• If a payment is refunded, the commission on it is reversed. If it was already paid to you, the amount is deducted from your next payout.
• We pay monthly: commission that’s payable by the end of a month is paid within the first 15 days of the next month, to the payout details in your portal (bank, PayPal or Wise). There’s no minimum amount.
• We may need a valid tax form (W-9 or W-8BEN) and correct payout details before paying. You’re responsible for your own taxes, and we issue tax forms such as a 1099-NEC where the law requires.

6. Rules

• Don’t make income or earnings claims to prospects.
• Describe Xcape Academy accurately: certificates are academy credentials, not licences or government qualifications.
• Don’t publish tuition prices; share official Xcape Academy materials and links only.
• Don’t run paid ads on Xcape Academy brand terms, and don’t send spam. Follow the marketing and anti-spam laws where you and your prospects live.
• Always disclose that you’re a compensated referrer.
• Your portal shows the names and enrollment status of students who used your codes. Use that only to support them, and never share it.

7. Changes to levels and rates

We may change levels, rates or hold periods. We’ll email you before a change takes effect, and it never changes the rate on enrollments already approved.

8. Ending the agreement

• You or we can end this agreement at any time by email. Your links and codes then stop working.
• Commission on payments made before the end is still paid once it becomes payable, unless we ended the agreement because you broke it.

9. Governing law

This agreement is governed by the laws of Queensland, Australia, and disputes are decided by the courts of Queensland, Australia. If you’re a consumer in the European Union or the United Kingdom, you keep the protections of your local law and can bring a claim in the courts where you live.

10. Changes to this agreement

If we change this agreement, we’ll publish the new version here with a new version number and ask you to accept it the next time you sign in. Questions: support@xcapetaxacademy.com.
