Instructor Agreement
Version INS-2.0 · Effective October 16, 2026
This agreement is between Xcape Tax Academy, 249 Oxley Ave, Margate QLD 4019, Australia (“we”, “us”) and you, as a Xcape Academy instructor. It works alongside our Terms of Service and Privacy Policy.
1. Your role
- We approve instructors after an application and an interview.
- You work as an independent contractor, not an employee. You provide your own equipment, internet connection and workspace, and you’re responsible for your own taxes.
2. Classes
- We assign you to live classes. Each class has scheduled sessions, which you see in your instructor portal with the meeting link we create.
- Teach accurate, current U.S. tax content, and tell us about anything in a class that needs review.
- Record attendance for your sessions in the portal; we record it automatically when students join, and you can correct it.
3. Pay
- We agree your pay for each class with you in writing before you teach it, and it’s shown on your Classes page. It’s either a flat amount per session you teach, payable once the session has been held, or a percentage of what students actually paid for the class, payable once the class’s last session has ended and 30 days have passed since each payment.
- If a student’s payment is refunded, percentage pay on it is reversed. If it was already paid to you, the amount is deducted from your next payout.
- We pay monthly: pay that’s payable by the end of a month is paid within the first 15 days of the next month, to the payout details in your portal (bank, PayPal or Wise). We may need a valid tax form (W-9 or W-8BEN) first, and we issue tax forms such as a 1099-NEC where the law requires.
4. Showing up
- Start every session on time. If you need to reschedule, give us at least 48 hours’ notice.
- A session cancelled with less than 48 hours’ notice, or one you don’t turn up to, isn’t paid. A second one within 6 months may end this agreement.
5. Class materials and recordings
- Slides, handouts, recordings and other materials you create for Xcape Academy classes belong to Xcape Tax Academy. You transfer to us any rights you have in them, and we may keep using them after you stop teaching.
- Material you owned before working with us stays yours; you let us use it in the classes you teach.
6. Selling lectures in the library
- Lectures you upload to the library stay yours. You let us host, stream and sell them in the library at the price you set.
- We review each upload before it’s published.
- You receive 80% of what the student paid for each of your items. A refund reverses your share.
7. Confidentiality and students
- Keep course materials and student information confidential, and use student information only to teach your classes.
- While you teach for Xcape Academy and for 12 months after, don’t solicit Xcape Academy students you met through the academy for paid teaching or tax services outside Xcape Academy.
8. Ending the agreement
- You or we can end this agreement at any time by email. Please finish the classes you’re already scheduled to teach, or help us hand them over.
- Pay you’ve earned is still paid once it becomes payable, unless we ended the agreement because you broke it.
9. Governing law
This agreement is governed by the laws of Queensland, Australia, and disputes are decided by the courts of Queensland, Australia. If you’re a consumer in the European Union or the United Kingdom, you keep the protections of your local law and can bring a claim in the courts where you live.
10. Changes to this agreement
If we change this agreement, we’ll publish the new version here with a new version number and ask you to accept it the next time you sign in. Questions: support@xcapetaxacademy.com.
